When You Hire Us for Your Personal Injury Case
When you first contact our office, an intake clerk or lawyer will contact you to gather information about your personal injury case.
Next, you will meet with a lawyer, either in person, over the phone or through video conferencing. During this initial meeting, the lawyer will be gathering the information needed to help you with your case. This initial personal injury case meeting is free.
From there, you have to decide if you want to hire our firm and the lawyer has to decide if he or she wants your case. A lawyer-client relationship on a personal injury case can be a long-term relationship. It is very important that the lawyer and client have a good connection and high level of trust.
Then we will monitor your medical recovery and take care your legal needs. This usually means ordering documents (like medical records) and dealing with the defendant’s insurance company. It could mean starting a lawsuit against the defendant, examining witnesses, hiring expert witnesses and going to mediation, pre-trial and trial. You will be involved and kept up to date, but, we want you to focus on your recovery. We will take care of the legal side of things.
Every personal injury case is different, but eventually your case will either settle or go to trial.
During settlement negotiations, you will be involved. We will be meeting with you and discussing any offers from the defendant’s insurance company. You will know how much the offers are and how much you will receive “in pocket” after fees, HST and disbursements. That way there are no surprises when it comes to fees.
Most personal injury cases do not go to trial. But, if it does, we will be there by your side, presenting your case.
We usually work on a contingency fee. That means that you are not charged anything until your case ends. We cover all of the legal costs and disbursements until then. When your case ends, your fee will be a percentage of the settlement or trial award. Therefore, if we do not recover any compensation for you, you do not pay us anything for fees. Our typical contingency fee is 30%.
